PATENTS ACT 1977: EXAMINING FOR PATENTABILITY

Patent Office—Practice Note

Patents Act 1977: Examining for Patentability

[2006] R.P.C. 6

This notice announces an immediate change in the way Patent Office examiners will examine patent applications for patentability. The new approach is very similar to that taken by the European Patent Office, and will not materially affect the scope of what is patentable. The change is subject to any additional guidance that may come from the courts as a result of further judgments or appeals.

Key Words: Patent examiners • Patent Office • Patentability • Practice notes • Substantive examination • Technical effect
