This case has been drawn to the Editor's attention as being the only decision to date involving s.3(3)(b) of the Trade Marks Act 1994. This decision was upheld on appeal in the High Court ([2003]] EWHC 970 (Ch), April 7, 2003) which held that there had been no error in the decision of the hearing officer. This latter decision is not reported here.
